 A homeless man seeking free food at Anthony’s Diner in Saint Johnsbury is accused of threatening to “rape” a waitress there. Anthony Heath, 33, is being held in the Northeast Correctional Complex on $2,000 bail. Attorney

Jennifer Cleveland, serving as a public defender, entered a plea of not guilty on Heath’s behalf. Heath is charged with aggravated disorderly conduct because he allegedly threatened serious bodily injury on May 11 after being told at Anthony’s Diner that the restaurant does not provide free meals. A waitress there told him he was mistaken. As he was leaving, he stated to the waitress who is 17 that he was going to rape and kill her. Prior to his arraignment on Monday, Heath had been subject to a court-ordered mental health evaluation, which had been scheduled to be held at the courthouse. The mental health professional showed up, but Heath did not. “We will release him as soon as the evaluation is completed,” the judge said. Once free, Heath is not allowed to contact the  server he allegedly threatened, and he has been banned from the diner.
