The estate of a bicyclist who was killed when struck by a Shelburne police cruiser during an early morning crash on Veterans Day on Shelburne Road in South Burlington has filed a wrongful death lawsuit against the town of Shelburne. SeanĀ Hayes, 38, of Burlington, had stopped on the side of Shelburne Road and was off his bicycle when he was struck by the police cruiser. Shelburne Police Sgt. Kyle Kapitanski was southbound and headed back toward Shelburne when his cruiser struck Hayes and the bicycle that was towing a trailer on Fayette Drive about 2:45 a.m. Shelburne Town Manager Matt Lawless said he was unaware of the lawsuit. Lawless did say he is still awaiting the outcome of the Vermont State Police investigation. He said Kapitanski, a 22-year police veteran, including two years in Shelburne, remains on paid leave.
